    本プロジェクトは、現代国際法学において流布し国家責任条文草案でも前提とされている、あらゆる義務違反は責任を生じさせるという「一般法としての国家責任法」を観念し得るのかという問題に、歴史的・分野横断的観点から迫ってきた。本年度は、プロジェクトの集大成として、国家責任法の歴史、実定法としての国家責任法の評価に関わる報告及び総括を行う研究会を行った。 第一に、「第一次大戦以前の国際法・国際法学における『責任』―国際法における国家責任法成立」と題する報告が行われ、19世紀以前には、正戦論において戦争の正当原因の一つとして賠償義務の存在が想定されていたこと、また、正戦論を前提としなくとも、慣習法たる責任法が戦争回避の手段として否定されていたわけではないことが確認され、国際法の国家責任法が成立したのは19世紀後半以降であるという従来の理解に修正を迫ることが出来た。また、19世紀の学説、実行共に、その適用対象を外国人損害に限定していたわけではなく、そうした観念は、むしろ戦間期に成立した可能性が指摘された。 第二に、「国際法における緊急避難の考察」と題する報告が行われ、国家責任条文草案成立以前の実行における緊急避難法理には、権利として存在する「自衛型」と義務違反の存在を否定する「不可抗力型」のものが存在し、一般法を志向し二次規範として機能する条文草案上の緊急避難とは異なり、事案に応じて一次規範のレベルで機能していたことが指摘された。 本プロジェクトによって、「一般法としての国家責任法」という観念が歴史的に一貫して採用されてきたわけではないこと、また、「責任」の意味や効果も個別の分野によって変わりうることが浮き彫りにされたことが大きな成果と言える。このことは、一般法としての国家責任法を想定すること自体検証を要することを意味し、条文草案の評価及び国家責任法の解釈論に大きな影響を与えるものである。

    This research is devoted to the analysis of the new trend of multi-functional negotiations, in examining, in particular, the multinational negotiation process of international environmental agreements and of economic partnership agreement. As the result of research, it becomes clear that there is some fundamental norms which lead and prescribe the negotiation process.

  • The Law of Treaties Reexamined in the Contemporary Context :Reality of the State Consent to Treaty Obligations

    This research tries to reexamine the law of treaties in the contemporary context. Recent developments, particularly those regarding reservations or interpretation, reveal the necessity to reconsider the very foundation of the law of treaties, i.e., voluntarism. Sakamoto examined the evolution of treaty obligations through his research on the International Covenant on Civil and Political Rights and the United Nations Convention on the Law of the Sea, with particular emphasis on the rules on treaty interpretation. Igarashi studied international legal issues related to the so-called post-war compensation and examined the evolution of interpretation of the Hague Convention and the Hague Regulation as well as the San Francisco Peace Treaty. Shibata, with his rich experience in practice in the fields, studied the influence exerted by treaty organs on the evolution of treaty interpretation as regards international environmental treaties, particularly the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal, and the Antarctic Treaty. Hamamoto studied the role of treaty organs and the evolution of treaty stipulations with regard to the International Covenant on Civil and Political Rights and the International Investment Agreements. Sakai took in charge of the law of international organizations, especially the law of the United Nations, and carried out case studies on recent peacekeeping operations. The results of the research are essentially descriptions of relevant phenomena and the research does not involve an extensive theoretical analysis or an examination of background of these phenomena. However, the research is considered to have produced appreciable results, taking into account the fact that these phenomena have not been sufficiently described in a comprehensive manner.

  • 多国間条約制度をその他の条約から差別化できる根拠

    1 本研究の目的は、現代の多国間条約への国家の合意が伝統的国際法にいう合意と質的に異なることを示し理論化することであった。本年度は、実際の多国間条約制度の示す現象と先行研究の理論が合致しない部分について、本研究の仮説の検証を行い、下記の知見をえた。 (1)多国間条約の解釈では条約の趣旨・目的を重視しており、明文のルールに違反する行為だけでなく、条約が基礎とする諸原則に反する行為を条約違反と解釈する場合がある。このような解釈は従来の解釈原則では説明できない。つまり明文の厳密なルールよりも幅広い、法的義務への合意が存在する。(2)厳密なルール遵守を要求せず、違法行為かどうかを問題せずに遵守を促進する手続が見られる。違法行為の発生が確定しないにもかかわらず行動の変更を求められる可能性に対して、国家が合意していることになる。(3)多国間条約制度における国家の合意が伝統的国際法上の合意とは異なっている。ただし実際にはこの傾向を強くみせる分野とそうでない分野があり、仮説は不十分であった。 2 研究に関連して学会報告を行った。 7月5-6日(於白)Fourth International Conference, CISS/ISA主催。 学会報告の結果は、裏面に記載した図書の一章を構成することとなっている。章の題目はConstraint on the Sovereignty in Disarmament Treaties-A Legal Analysis of the Chemical Weapons Convention-である。 7月12-13日(於豪)「Frontlines : Gender, Identity and War」, Monash University主催。 報告題目:The Law of War in the Light of "Comfort Women" Issue 3 先行研究として重要な文献の書評を執筆した。これらは裏面に記載した。
