- Japan Society for the Promotion of Science, Grants-in-Aid for Scientific Research Grant-in-Aid for Scientific Research (B), Grant-in-Aid for Scientific Research (B), Kobe University, 01 Apr. 2019 - 31 Mar. 2023Cooperation of Humanities and Sciences to Establish an Empirical Research Project for Implementing and Examining "Global Welfare"本研究は、以下の3つの切り口から文理協働による共同研究の遂行を目的としている。第一に、移民・難民の起源地における住民の基本的な生活条件を直視することを通して、大規模な移民現象のプッシュ要因を文理両面から総合的に再検討する。第二に、多領域横断的な研究体制を構築し、必然的に文理融合的な様相を呈する移民・難民の起源地の生活条件の問題に、学際的なチームが協力して打開策を検討する。第三に、開発援助が実施されている地域に実際に生きる人々/それらの地域を故郷とする人々が、様々な援助をどのように受け止め、また将来に向けていかに活かせるのかを分析する。 残念ながらコロナ禍の影響によって、イスラム圏から来た在日外国人の聞き取り調査など国内での調査研究は実施することができたものの、ホンジュラス、南アフリカ、モロッコ、ケニア、イラン、キルギスタン、インドネシア、フィリピン等の国々を対象に、医学、社会学、法学、人類学、教育学、政治経済学等の多様な角度から現地調査を遂行し、どのような開発援助の問題点が現地で明らかとなっているのかを分析するという目的は果たせなかった。 しかしながら、この間、インドネシアのアイルランガ大学や南アフリカのケープタウン大学をはじめとする海外の研究者や世界銀行、ユネスコ、ユニセフとは、海外共同調査やワークショップ開催に向けて定期的にコンタクトを取り続け、海外調査や研究集会を再開するための準備を着々と進めることができた。
- Japan Society for the Promotion of Science, Grants-in-Aid for Scientific Research, Grant-in-Aid for Scientific Research (C), Kobe University, 01 Apr. 2014 - 31 Mar. 2020Study on the Normative Justifiability and Theoretical Implications of a Human Right to Democracy as a Collective RightLegal and political “boundaries” between political communities remain critically important in the implementation of our basic rights, despite the rapid progress of globalization. I made this point clear by introducing the idea of legal space, which is still indispensable for the implementation and protection of our rights to liberty and equality through due procedures. I also emphasized the significance of paying attention not only to how the basic values, such as freedom, equality, and justice, should be actualized within specific legal spaces, but also to how boundaries between political communities work to promote or even thwart the basic values embraced by democratic societies. Then, I highlighted the importance of the borders of law, which have garnered less attention so far, but which can be crucial for our project of advancing liberty and equality beyond national boundaries.

- 日本学術振興会, 科学研究費助成事業 奨励研究(A), 奨励研究(A), 神戸大学, 1998 - 1999近代法思想の形成過程における環境観の変動の意義に関する研究平成10年度は、ルネッサンス期から近現代にかけての環境観をめぐるさまざまな資料を調査・収集するとともに、マーチャント、ミース、イリイチらを初めとするエコ・フェミニズムの基本的な文献を読解することによって、近代初期の〈環境への態度〉の変化が、人間観や世界観の根本的変動と連動して起こっていることを明らかにしようと努めた。 平成11年度はこの作業をさらに推し進めた。第一に、17世紀イギリスにおける自然哲学の進歩に多大な寄与を果たしたベーコンの原典および二次文献の分析を行い、このエポック・メイキングな人物が、いかにして環境観の変動を推進したかを追究した。その結果、すくなくとも、彼がルネッサンス以降盛んになった〈女性としての自然〉というイメージを巧みに利用しつつ、科学技術による〈自然の支配〉を唱道して、人類の物質的福利の向上をめざそうとしていたことが明らかにされた。 第二に、原子論的・機械論的自然哲学がまさに形成されつつあった17世紀中葉のイギリスにおいて、プロテスタンティズムという背景を共有するヴァーチュオーシ(科学的探求に深く係わった人々)によって、どのような自然論・環境論が展開されていたかを探求した。研究の結果、たとえばJ・グランヴィルは、ベーコンを忠実に踏襲して、自然科学の目的は自然を支配することによって人間生活を改善することだと考えていたこと、また王立協会の中心的メンバーだったボイルは、物質を〈生命なき〉諸粒子へと還元する一方、自然を人間にとって便利な生活品を供給する〈倉庫〉に格下げすることにより、環境へのはっきりした人間中心主義的・権力的態度を示していたことが、明らかになった。
- Japan Society for the Promotion of Science, Grants-in-Aid for Scientific Research, Grant-in-Aid for Scientific Research (B), KOBE UNIVERSITY, 1994 - 1996Studies on the Genesis and Development of the Legal and Scientific Concepts of Law of Nature and Their Philosophical SignificancesBy prosecuting this research project from 1994 to 1996, we, the participants in it, obtained the following main results, Prof. Katayanagi made it clear from the viewpoint of Scriptual hermeneutics that the religio-legal thought of the Old Scriptures war closely interrelated with many national severe experiences of the Israelites of antiquity Prof. Yokoyama found through the analysis of documentary evidence that the historical development of Platonism from the end of the classical antiquity to the school of Chartres of the twelfth century playd an important role in establishing the scientific concept of law of nature. Prof. Sakurai showed by a betailed study of the chief book of R.Cumberland entitled De Legibus Naturae Disquisitio Philosophica (1672) that his thought on the laws of nature reflected remarkably the social interests of the English Establishment of his age. Prof. Munakata made a general survey of various thoughts on the laws of nature from Descartes of the first half of the seventeenth century to Rousseau of the middle of the eighteenth century and explained their intricate mutual relations from the point of history of philosophy. Prof. Miura made a pioneering study of the historical development of the religious attitudes in the Islamic World toward the scientific laws of nature and showed that modern Islamic responses to Western modrn science was connected with traditional Islamic attitudes. Prof. Yamazaki made it clear through a detailed analysis of contemporary legal controversies on abortion and Euthanasia that some thoughts based on natural laws are hidden in various life-ethical attitudes. Prof. Mizutani paid his attention to contemporary computer-ethical problems resulting from the extremely rapid popularization of personal computers and showed through an analysis of some criminal suits that many confusions are brought about by the traditonal legal responses based on the analogy with legally established old cases.
