• Sea Level Rise and State Obligations under the Law of the Sea: Baseline Preservation Without Updating Charts?

  Abstract Climate change-induced sea level rise, which causes physical changes in the maritime features, may lead to the inundation or erosion of low-lying coastal areas and islands and, therefore, raise various issues related to the law of the sea, such as the legal status of baselines and outer limits of maritime zones. While the ICJ advisory opinion on climate change and the ILC Study Group, confirmed that UNCLOS imposes no obligation on States to update charts or lists of geographical coordinates once duly deposited, they did not declare that the baselines and maritime zones can be fixed regardless of the physical changes resulting from sea level rise. This article revisits the historical and doctrinal foundations of the baseline, contrasting the traditional “ambulatory baseline” theory with contemporary arguments for “fixed baselines” grounded in legal stability. Through critical analysis of those theories and processes, it identifies significant limits to relying solely on charting or deposit obligations to preserve maritime entitlements. Given the absence of explicit obligations and the growing expectation among States to secure existing baselines and maritime zones, the article concludes that development of new rules, potentially through the adoption of a UN General Assembly Resolution, would be the most feasible option for baseline preservation.

• 国連環境総会における海洋プラスチックごみに関する新たな条約策定の動き

  2017年に開催された国連環境計画の第3回国連環境総会（UNEA3）において、マイクロプラスチックを含む海洋プラスチックごみ対策の現状把握や、新たな法的拘束力ある文書の採択を含む今後の対策オプションの検討を目的とする専門家会合の設置が決定された。2020 年の専門家会合による既存の取り組みにおける様々なギャップ・障壁に関する報告を受け、現状に不満を持つ複数の国は法的拘束力のある文書の交渉開始を支持している状況にある。本稿では、専門家会合を含むUNEAにおける議論経緯を中心に、海洋プラスチックごみをめぐる新たな条約策定の動きについて紹介する。

  研究計画で予定していた個々のテーマについて検討を進め、今日の国際組織が海洋法において果たす役割の動態的な展開（紛争解決、法定立、ガバナンス、非国家主体との連携協力等）を把握することができた。今年度取り扱った具体的な論点は、漁業資源管理、捕鯨、航行、海洋汚染（プラスチックごみ）、北極海、海底開発、およびBBNJ新協定等である。これらの検討結果は研究代表者、分担者それぞれの成果を論文、口頭発表の形で発表した。 また、研究代表者、研究分担者の編著による最新の研究論文集、国際法の基本書、判例集等も刊行した。国際法研究者向けの専門的な発表のみならず、一般向けの公開講座（国際法学会市民講座「海と国際法」）や他分野の辞典・図書類（『現代地政学事典』『海とヒトの関係学3 海は誰のものか』）等を通じて研究成果を公開する機会も得られた。 国際的な研究成果としては、国際学会での研究発表、研究分担者と海外研究者の国際共著による英語図書の刊行、そして本研究プロジェクトが企画した「第8回日中海洋法ワークショップ」等が挙げられる。特に「第8回日中海洋法ワークショップ」は本研究プロジェクトと中国・海洋発展戦略研究所（CIMA）および西安交通大学が2019年9月11日に西安市（会場は西安交通大学）で共催したもので、研究分担者5名を含む日中の海洋法研究者（海洋法実務家、外交官等を含む）総勢14名が研究報告と活発な意見交換を行なった。この際、来年度以降も日中間での研究交流を一層推進することについて合意を得られた。
