- Japan Society for the Promotion of Science (JSPS), Grants-in-Aid for Scientific Research, Doctoral Course (DC) Research Fellowships, Kyoto University, Apr. 2020 - Mar. 2023Validity of Consent in the Use of Force Based on Consent2年目にあたる今年度は、前年度の研究を前提として、同意に基づく武力行使の理論的問題(なぜ領域国の同意があれば当該領域国内での他国による武力行使が正当化されるのか)に取り組んだ。 先行研究は大きく2つの見解に整理された。すなわち、同意が武力行使の違法性を阻却するという見解と、同意があればそもそも武力行使が発生しないという見解である。この対立は、国際法委員会(ILC)での国家責任条文の作成における議論で、同意を違法性阻却事由として位置づけることに対してなされた議論が対立の根底にあることが指摘されている。しかしながら、原則例外論、証明責任の分配、規則の保護法益の性質および規範的含意の違いの観点から、(武力行使の文脈を離れて)国際法一般における同意の法的性質の問題を検討した結果、実際は、国際法一般における同意の位置付けをめぐる議論とは関連がないことが明らかとなった。真の対立の原因は、むしろ、武力行使禁止原則の強行規範性の問題から回避しようとする試みにあり、しかしながら両説とも回避しきれていない。それは、両説とも武力行使禁止原則を国家対国家的にのみ捉えているからである。この視座のみで武力行使禁止原則を捉えている限り、同意に基づく武力行使の正当化理論は理論的に不十分で実践的にも有意でない。 そこで従来の理論を克服するために、武力行使禁止原則を国家対国家視座と人間的視座の両視座から捉えるという二元的な理論的認識枠組を打ち立てた。国際法一般に見られる人間的視座を武力行使禁止原則に導入することにより、武力行使がなぜ、そしてどういう場合に同意によって正当化されるのかという問題を統一的・整合的に理解できる。さらに、武力行使禁止原則のこの二元的理解の法的・理論的・思想的基盤と、これまでのjus ad bellumの各議論との関連およびインパクトについて検討した。
