    Abstract This article examines Japan’s ‘Justice Affairs Diplomacy’ and the role of international dispute resolution in Japan’s diplomatic strategy. In recent decades, Japan has sought to position itself as a hub for international arbitration through legal reforms and institutional initiatives, including accession to the New York Convention, ratification of the Singapore Convention on Mediation and revisions to its Arbitration Act. Despite these developments, the diplomatic implications of Japan’s dispute resolution initiatives remain underexplored. This article asks how Japan’s promotion of arbitration and alternative dispute resolution contributes to its broader diplomatic posture. By examining legal reforms, institutional initiatives and developments such as Shift Energy and Others v. Japan , it argues that arbitration functions not only as a mechanism of commercial governance but also as a diplomatic instrument through which Japan projects legal influence and engages regional and global actors.

    Abstract A private plaintiff may bring an action against a defendant for the infringement of competition law. In Western countries, it is widely accepted that parties can subject to choice of forum agreements claims seeking private law remedies based on competition law infringements. Accordingly, parties are free to refer those claims to a foreign court or arbitral tribunal for their determination. In contrast, it remains an open question in most Asia-Pacific jurisdictions whether competition-related claims are subject to choice of forum agreements (in particular, an arbitration agreement). If the answer is affirmative, a number of incidental questions will arise. For instance, in what kinds of competition-related claims and under what circumstances will choice of forum agreements be applicable? With focus on international arbitration, this article will look into recent developments around the globe and then propose how states in the Asia-Pacific region should approach those issues.

    Abstract Most states have a national anti-trust or competition law to regulate anti-competitive activities. There is no doubt that, in purely domestic cases, where an anti-competitive activity and its anti-competitive effects have occurred within a state, that state’s national competition authority can regulate the activity by applying its competition law. For cross-border cases such as where anti-competitive activities are carried out abroad but have anti-competitive effects on the domestic or internal market of that state or region, it has been gradually accepted that a state can apply its competition law to the activities on the basis of the effects within its territory. However, it should be noted that states have approached such cases differently. In 2017, the Supreme Court of Japan first decided the international scope of the Japanese Anti-Monopoly Act (JAMA) in cross-border cartel cases and clarified that the JAMA could apply to anti-competitive activities conducted outside of Japan if the activities in question disturbed the free competition economic order of Japan. The court did not mention the effects doctrine or the territorial principle. This article examines on what grounds and how far the JAMA can and should apply to cross-border cartel cases by analysing the Supreme Court judgement.

    本研究は、国際仲裁における競争請求をめぐる法的状況を明らかとすることを目的とするものである。本年度は、①国際仲裁と競争請求に関する文献の収集・現地調査、②研究成果のとりまとめ・公表を行った。 ①国際仲裁と競争請求に関する文献の収集・現地調査:前年度からの継続事項として、国際仲裁と競争請求に関する文献を収集すると同時に、シンガポールおよびミャンマーの研究者・実務家に対するインタビューを実施し、各国における最新の動向についても調査を行った。実地調査の結果、ミャンマーでは、競争請求そのものがほとんど認識されていないこともあり、国際仲裁との関係についてほとんど議論がないこと等、シンガポールでは、競争請求自体は認識されているものの、国際仲裁との関係ではあまり議論がないこと等が判明した。 ②研究成果のとりまとめ・公表:競争請求の仲裁可能性と競争請求に関する仲裁判断の執行可能性の問題については、一定の成果を見ることができたため、研究成果を研究会および学会において報告したほか(第6回北陸国際関係私法研究会、国際法学会2018年度(第121年次)研究大会)、当該研究報告に基づく論文を学会誌(国際法外交雑誌)において公表する予定である。また、競争請求の準拠法との関係では、競争法の国際的適用範囲が問題となることから、日本の独占禁止法の国際的適用範囲についても研究報告(2018年5月度渉外判例研究会)を行うとともに、研究成果を公表した(「外国で締結された国際カルテルへの独禁法の適用を肯定した事例-最三小判平成29・12・12」ジュリスト 1526号142-145頁)。その他の問題については、2019年内に研究成果を公表する予定である。
