• Patent management and the globalization of firms: the case of Siemens (1890–1945)

  The purpose of this paper is to discuss how multinational enterprises have historically managed global patenting and to what extent the localization of patent management has supported the expansion of these enterprises. This study focuses on the electric appliance industry (one of the first industries to see the emergence of global companies) and consider the case of Siemens, a German multinational company, comparing it to General Electric (GE), an American company. The work adopts a global business history approach. Taking GE’s global patent-management model, described by Nishimura (2004, 2009, 2016), as the benchmark, this study analyzed Siemens’ worldwide control of its intellectual property rights between 1890 and Second World War, using German, Japanese and American primary sources. Patent management is a common means for firms to globalize and transfer technology internationally, but it can take various forms. While GE transferred patent management to its foreign subsidiaries (a process known as localization), Siemens kept worldwide patent management at its headquarters – except in Japan, where in time it transferred this activity to a joint venture. The transfer of production called for localization of patent management while focusing on exporting to other markets made it possible to keep patent management at headquarters. Patents are usually a source for quantitative surveys. This paper uses them to discuss how multinational companies manage property rights globally. It is the first paper to address this issue by comparing two major actors in a similar industry.

• The Making of Japanese Patent Culture: The Impact of Westinghouse’s International Patent Management

  This paper clarifies Japanese patent culture from the viewpoints of patent management and international business history. We examine the cases of Westinghouse Electric and Mitsubishi Electric. Although Westinghouse granted exclusive licenses to Mitsubishi, it controlled its Japanese patents directly through its own patent agent. Therefore, positive influences of Westinghouse's international patent management on Mitsubishi were limited. Rather, Mitsubishi developed its patent management comparatively independently. In 1923, Mitsubishi appointed a person to be in charge of patent affairs exclusively, followed by the formation of a patent section. Since 1935, the patent department began administrating patent applications internally. Mitsubishi accumulated the organizational capability to apply for and administrate a volume of patents in the course of technical tie-ins with Westinghouse. This is the context of the creation of a Japanese patent culture. On the enforcement side, Mitsubishi Electric created a reconciliation system with competitors. Japanese electrical companies did not claim their rights strongly, but instead acted harmoniously toward each other. The reconciliation system consisted mainly of Mitsubishi, Shibaura Works, Hitachi, and Fuji Electric. This represents another feature of Japanese patent culture.

  本稿の目的は，ヤマハ発動機にかかる特許書誌情報を分析し，同社の知財管理部門による出願マネジメントの展開を国内優先権主張出願制度の利用から明らかにすることである。特許出願に関係する考えや意識をできるだけノイズが入らないように解析するため，ヤマハ発動機のみが出願人となっている自社単独特許出願のうち，発明者の所在が静岡県磐田市内となっているもののみを分析対象とし，出願数や発明にかかる研究規模，国内優先権主張出願制度の活用の経年変化を検討した。その結果，2005年前後から同社は国内優先権主張出願制度の活用を始め，研究活動の持続性を考えた特許出願と管理を展開していることが明らかとなった。

• An Innovation Study on Patent and Design Right System

  本稿は企業による意匠制度の利用実態を明らかにするとともに，意匠制度とイノベーションの関係を考察している。意匠統計をみると1990年代以降，意匠出願・登録ともに件数が低下し，制度利用が消極化している実態がある。他方で個別企業分析を行うと意匠出願を継続的に行っている企業があることもわかる。空調・冷凍機事業を中核とするダイキン工業は，エアーコンデイショナの吹き出し口など外形的デザインと機能性を併せ持った構造を意匠権によって保護し競争優位を確保している。意匠制度は製品イノベーションだけではなく顧客志向型のサービスイノベーションを促進する制度であるが，他方で企業による制度利用の低迷を解明する課題も残されている。

• The Organization of Corporate Patent Management in US Companies: A Case Study of the Thomson- Houston Electric Company

  This paper aims to describe the process of internalization of patent control into the modern industrial enterprise, and to clarify the organization of the patent department of the Thomson-Houston Electric Company. Up until 1888 the patent application and related Thomson, for almost of all of the patents of the company were many competitors to become a big company having many investors and ingestions. Around 1891, the patent department was headed and supervised by patent attorneys as counsel was organized. This course is so different from that of Japan.

• Frontier orbital theory and industry-university cooperation: an analysis of Ken'ichi Fukui's patents

  This paper aims to clarify the nature of industry-university cooperation by analyzing patents. The national research and development system during the era of high economic growth was characterized by the creation of direct and individual cooperation between industry and universities. Ken'ichi FUKUI's scientific research on frontier orbital theory was accomplished through such cooperation. Close relations between scientific and applied research had continued since the prewar era. FUKUI engaged in both theoretical and development work in polymerization of polyethylene and new plastics, topics that were of keen interest to the petrochemical industry. One feature of this period was that FUKUI was able to manage his research by undertaking joint research projects in collaboration with many companies and benefit from funding and information on market needs to accomplish his frontier theory. The other feature was that the companies that took part in joint research with FUKUI utilized the laboratory results exclusively by applying for patents for FUKUI's inventions in the names of the companies themselves. Thus one of the conditions of scientific research during this time was the flexibility that allowed academic research to undertake topics of practical application in society and direct and individual cooperation with industry.

• GE's International Patent Management before World War II: The "Proxy Application" Contract of 1919 and Organization of Tokyo Electric

  This paper examines the patent management of General Electric Company (GE) in Japan before World War II. It is said that its domination of the incandescent lamp industry, which occurred from 1912 to 1919, was brought about on Tokyo Electric's own initiative. But GE had controlled substantial patents for tungsten filament, which included patents applied for and registered by German companies. From 1916, GE filed a series of suits against newly established Japanese lamp companies, Taisho Denkyu, Dainihon Denkyu, and Kansai Denkyu, which were based on the foreigner-owned lamp patents not controlled by GE. By 1919, GE won the suits and absorbed those companies. Therefore, the Japanese lamp industry was dominated by GE, not by Tokyo Electric.
  In 1919, GE established International General Electric Co., Inc. (IGEC), and IGEC revised its agreement with Tokyo Electric. The new agreement contained a "proxy application" clause, which provided that Tokyo Electric could apply and register GE'S patents in its own name and on own cost. That is, in the interwar period, GE managed its Japanese patents through Tokyo Electric's managerial function. As similar contracts had already been concluded with British Thomson-Houston and Allgemeine Elektricitäts Gesellschaft, GE had completed an international "proxy application" network.
  In order to carry out the contracts and patent management through Tokyo Electric, GE had to intensify the patent management function of Tokyo Electric. In 1921, J.R. Geary, charged with GE business in Japan, directed Tokyo Electric to establish a patent management department. The Patent Department started "proxy applications" in 1922. Moreover, in order to strengthen the department, Geary recruited Rinji Fujii, former engineer at the Japanese Patent Office, and put him in charge of the department in 1924. With this the functional transfer from GE to Tokyo Electric was completed.

• The Absorption of International General Electric and Changes in General Electric's International Strategy

  In 1952, General Electric Co. (GE) absorbed their completely owned subsidiary, International General Electric Co., Inc. (IGEC) and made IGEC a division of the company. This article explores the reason for this absorption from the viewpoint of GE's export trading. If we limit ourselves to only some indicators of international cartel and foreign direct investment, we cannot fully examine GE's international business history.During the interwar period, GE had led international cartels, the Phoebus Agreement in the electric lamp field, and the International Notification and Compensation Agreement in the electrical apparatus field to protect the American market and to compete in the export market. Because of the segregation of the domestic market from the foreign market and the different way in which business was conducted, the structure of IGEC was appropriate for its international strategy.But World War II changed the export market. First, the war cut off the relationship between IGEC and the London-based cartels. Second, the German and Japanese industries dropped out of the international market. And, after the war, the general demand for electrical apparatus and appliance rose significantly. In this favorable environment, GE decided to strengthen its export effort. It, however, met with stiff competition from Westinghouse Corporation (WH). In order to compete with WH, GE needed to adapt its own manufacturing facilities to the exporting business. GE then absorbed IGEC and changed its managing structure into a multidivisional one.

  This study examines patent management of multinational enterprises and its impact on international technology transfer and research and development, through case studies of pre-World War II electrical and electronics manufacturers. The results revealed that patent management controls and regulates not only cross-border technology and knowledge transfers, but also transactions across corporate boundaries. It also became clear that the patent management department plays a role in organizing the flow of technology and knowledge within and outside the company on a global scale and facilitating research and development.

  ①戦略と組織構造 このカテゴリーで明らかにすることは以下の2点であった。(A)多角化戦略と事業部制組織は各国、各企業でどのように形成されてきたか。 (B) 多角化戦略と事業部制組織は各国、各企業でどのように失敗し、崩壊しようとしているのか。このカテゴリーについては谷口明丈を責任者として研究が遂行され、研究成果は現在出版の準備が進められ、2021年度中には出版される予定である。 ② 人的資本・人的資源 このカテゴリーでは、次の3つのサブカテゴリー、(A)基幹労働者、(B)技術者、(C)マネージャーの分析がなされた。この3つのサブカテゴリーは戦略の変化に伴ってその位置づけを変化させながら、雇用・昇進・報酬のシステム、教育システムをどのように変化させてきたのかを明らかにする研究が、谷口をアメリカの、菅山真次を日本の、田中洋子をドイツの責任者として出版を前提に進行中である。 ③ 組織能力 このカテゴリーについては、理論的な整理検討が必要であり、宇田理・谷口を中心にそのための研究会がもたれた。個々の企業の組織能力の形成過程と、その変化については、①と②の研究成果を基礎に④の研究と連関させながら、総合電機企業史の4つのステージにおいてそれぞれの企業がどのような組織能力を形成し、それはどのような優位性もち、弱点を抱えていたのかを明らかにするための準備がなされた。 ④グローバル経営史 このカテゴリーでは、①，②，特に③の研究成果に依拠しつつ、それぞれ独自の組織能力を形成してきた各企業がグローバルな舞台において 競争、協調、ネットワーク形成といった諸関係を取り結びながら、どのようにして産業を形成してきたのか、そのプロセスを明らかにするための準備作業が行われた。

  This research focuses on three companies, Hitachi, General Electric, and Siemens, which are general electric companies that have continued to be the leading companies in the electrical machinery industry, which represents the twentieth century industries. By comparing and examining “Strategy and organizational structure”, “Functions” and “Social relationship” in the period from its birth to today, this research highlights the characteristics of Japanese companies, American companies and German companies, and also analyzes the competition, coordination and mutual penetration of companies in three countries, which will contribute to “International business history”. Furthermore, it was carried out for the purpose of comprehensive research that clarified common characteristics as a twentieth century company or a general electric company.
