  本年度は、前年度の未達部分である熟慮的自由説と尊重説の長短を比較検討するとともに、研究計画調書「研究目的、研究方法など」の「本研究の目的」に記載の通り、熟慮的自由説と尊重説を指導原理とした、あるべき差別禁止法の理論の構築可能性について検討した。 熟慮的自由説と尊重説の長短の比較検討は本年度の前期（4月-9月）に行った。前者についてはS.Moreau、後者についてはB.Eidelsonによる説の理論的内実を明らかにした。前者は被差別者が差別されていることを認識していない場合においてその道徳的不正性を説明することが困難である点で、後者と比べた理論的短所を有することが明らかになった。 熟慮的自由説と尊重説を指導原理とした、あるべき差別禁止法の理論の構築可能性についての検討は本年度の後期（10月-3月）に行った。具体的には、間接差別や構造的差別の問題に法はどう介入するべきかという論点について、両説の含意を検討した。 熟慮的自由説は間接差別などにつき、特定の集団に属する個人の自由が行使困難になると説明することで、直接差別とともに統一的に説明可能であることが明らかになった。尊重説は間接差別などに対し、個人の尊厳を蹂躙するような直接差別にメタレベルで従事しているものについては自らの理論に包摂する一方で、そうでないものについては差別に内在的な道徳的不正性によって統一的に説明することを放棄するという戦略を余儀なくされることが明らかになった。 もっともそもそも間接差別などを差別の中心的事例として位置づけることが適切か（差別以外の概念で捉えるべきではないか）は論争的であり、差別禁止法上の間接差別概念もあくまで直接差別の立証を緩和するための推定規定と理解することも可能であるため、間接差別などを差別概念に包摂できないという尊重説の特性は致命的な欠陥にはならないことが暫定的に結論づけられた。

  本研究の目的は、世界正義理念の再構築を通じて、日本の移民難民政策の規範的指針を提示することである。 初年度は、特に「世界正義理念の再構築」という点に焦点を当てて研究を遂行するとともに、日本の入管法改正という新たな動向に対応するための研究を遂行した。 本年度は、研究代表者・研究協力者の合計8名が、ルツェルン大学で開催された第29回法哲学社会哲学国際学会連合世界会議（IVR）にて、これまでの成果を発表し、フィードバックを得た。 また、「日本の移民難民政策の規範的指針の提示」に関する研究を遂行するため、研究代表者・研究協力者が参加する研究会合を催した。第1回会合（5月）では、研究協力者が移民の社会的包摂とメンバーシップについて報告し、参加者で討論した。第2回会合（7月）では、UNHCR日本事務所の方をお招きし、日本と世界の難民の現状に関して講義をしていただいた。第3回会合（10月）では、研究協力者が世界経済的正義と移民正義について報告するとともに、難民支援協会の方をお招きし、日本の難民支援について現場の視点から講義していただいた。第4回会合（12月）では、研究協力者がケア労働者の国際的移動とジェンダー平等について報告するとともに、IOM日本支部での活動経験を持つ方をお招きして、IOMの活動と日本の難民政策について講義をしていただいた。第5回会合（1月）では、研究協力者が関係的平等主義の観点から移民正義論の理論的検討を行うとともに、フランスの思想に詳しい外部講師をお招きし、フランス憲法体制における「ライシテ」概念と宗教的・文化的少数派をめぐる問題について講義をしていただいた。 加えて、研究代表者らが、移民正義論の研究者として国際的に名高いジョゼフ・カレンズ氏が講演する国際研究会や、移民政策学会に赴くなどを通じて、本科研の課題に関連する情報を収集するとともに、参加者と意見を交換した。

  地域の再生を通じて、社会保障の持続可能性を支える市民的基盤の再構築を図ることを目指して、そのために求められる規範的諸条件や法的基盤とは何か、という学術的「問い」を立て、包括的相談支援（寄り添い型・伴走型支援）のあり方に焦点を当て、法学研究者を中心とした学際的研究と、実務家や自治体職員などとの実践的研究から得られた知見をもとに、共同研究を積み重ねてきた。 今年度も、これまでと同様、研究者中心の地域共生社会理論研究会、研究者・実務家中心の福島地域包括ケア・地域共生社会研究会及びがじゅまる研究会を度々開催した。 3年計画の最終年度ということもあり、理論研究会では、執筆予定の共同研究者による研究報告会を連続的に開催した。年度内の発刊には間に合わなかったものの、その成果物として、2022年6月中の出版を予定している（菊池馨実編『相談支援の法的構造ー「地域共生社会」構想の理論分析』信山社）。福島研究会では、研究会や現地取材を通じた被災地支援者及び住民へのインタビューを重ね、2022年2月成果物の刊行に至った（菊池馨実＝鈴木典夫編『原発被災した地域を支え、生きる－福島モデルの地域共生社会をめざして－』旬報社）。がじゅまる研究会では、既に前年度、研究成果物を発刊済みであり（朝比奈ミカ＝菊池馨実編『地域を変えるソーシャルワーカー』岩波ブックレット）、今年度は全国各地の実践者をゲストに招いての研究会を連続開催し、知見を深めた。 さらに地域共生社会をめぐる政策形成過程の記録との観点から、田中聡一郎准教授（駒澤大学）を研究協力者として迎え、共同作業により、月刊福祉2021年5月号から2022年4月号にかけて、「生活困窮者自立支援から地域共生へ」とのタイトルで12回連載のインタビュー企画を掲載した。その成果は、2022年度中に全国社会福祉協議会出版部での刊行が内定している。

  The goal of this research is to integrate a normative theory of equality with that of discrimination through the development of a theory of relational equality, with the aim of constructing the shared basis of communication between legal philosophers and positive lawyers over the ideal of equality. To pursue this goal, I grappled with the following two basic tasks. First, I summarized the various arguments over "What is discrimination?" and showed that some positions regarding these issues could be explained by their particular commitment to theories about "Why ought we not to engage in discrimination?" Second, I examined the question of which theory of the moral wrongness of discrimination my theory of relational equality would endorse the most.

  The purpose of our research is to construct a new philosophical foundation of ‘global legisprudence’ by developing and integrating the theoretical resources of legisprudence and global justice. We revealed that the conventional theories of legisprudence which almost exclusively focused on domestic legislation could not appropriately deal with the problems that domestic legislation and global order formation interacted with each other. Then we presented some guides for division of labor between domestic legislation and global law-making, and explored how to guarantee democratic accountability of both. Thereby we built a philosophical foundation of global legisprudence.
