• Securitization of Water and Trends in International Legal Policy

  今世紀に入り、「水の安全保障」の概念が注目を集めている。しかし、その定義が国際的に確立しているわけではない。むしろ、国家は独自の戦略的な狙いにより水問題を「安全保障化」させてきた。水を介した脅威を除去ないし低減させる対応策もまた、「平和と協力の道具としての水」や「持続可能な発展のための水」の理念の下で各国から示されている。国際法政策の動向に目を移すと、水の安全保障化に基づき例外的措置を正当化しようとする国家の法的主張が注意深く退けられており、他方で、協力を通じた越境水域の管理、武力紛争時の水施設と環境の保護、水・衛生・環境に対する人権の保障、生態系の保全などを推進する国際法制度を強化する傾向が見られる。水の安全保障を確保するグローバル・ガバナンスにおいて、安全保障理事会が担う役割への期待は高まっているが、武力紛争に関連する事態を超えて役割を拡大する際には、慎重な体制整備が必要となる。

• Settling Water Disputes through International Investment Arbitration: When and by What Standards?

  The development of water law as environmental law may trigger disputes over investment projects, which could find their way to international investment arbitration. Consequently, domestic water law and administration can be subjected to international scrutiny. This article analyses relevant investment treaty provisions and cases concerning water resources management to examine (i) when water disputes can be submitted to investment arbitration and (ii) what standards tribunals have applied to settle them.

• Public participation in the global regulatory governance of water services: Global administrative law perspective on the Inspection Panel of the World Bank and amicus curiae in investment arbitration

  Water services are increasingly subject to global regulation, forming the global water governance. The World Bank's technical advice and the decisions of investment arbitration are prominent examples of such influence. However, because of the distance of their decision-making from the citizens and their institutional settings, they have raised legitimacy concerns. This paper applies the global administrative law framework to examine the roles and effects of participation procedures, namely the Inspection Panel at the World Bank and submissions by a third person (amicus curiae) in investment arbitration.   水をめぐる紛争（コンフリクト）は、当事者の認識の不一致や根深い価値対立が見られる場合が多く、また科学的根拠自体が争点になることも少なくない。こうした問題意識のもと、本研究は、水をめぐり生じる紛争の予防と解決を担う国際制度の機能に着目し、その変化を解明することを目的としている。 本研究では、司法機関を検討の対象としている。裁判所や仲裁が関係を確定させることで紛争を「処理」する機能に限定せず、それら手続の作用をより広く捉え、紛争当事者間の対立や緊張関係を解消させる機能に注目している。初年度である2021年度は、判例や事例研究を進展させた。まず、水に対する人権に関連する最新の欧州人権裁判所および米州人権裁判所の判例を検討した。次に、過去の国際河川をめぐる紛争処理の事例を再検討し、国際裁判所の判決がいかなる紛争解決機能を担ったのか、考察を加えた。さらに、水資源管理に関わる問題が付託された投資条約に基づく投資家対国家の仲裁判断を選び、条約規定や判例分析を行った。こうした研究の成果は、研究会や学会で発表しており、現在、論文の公表に向けて準備を進めている。 司法機関以外の国際制度も多様に設立されており、特に河川流域委員会をはじめとした機関の機能が本研究の重要な対象である。2021年度は、グローバルな適用範囲を持つ条約に焦点を絞り、分析を進めた。 本研究の最終的な目標である、現行制度の体系的な記述と評価に向けては、まだ道半ばであるが、徐々に水の特性に応じた制度設計および運用上の理念や原則が明らかになってきた。

• The Structure of Global Administration and the Function of Law in Promoting Integrated Water Policies

  本年度は、研究プロジェクトの1年目であり、幅広い資料を収集することを、第一義的な目的としていた。先行研究のレビューは、関連文献の多さから完了していないものの、重要なものに関して整理を進めることができた。また、水に関する国際法および関連実行について、順調に資料の収集と整理を行うことができた。特に上半期には、指標によって国の行動の進捗管理が行われる持続可能な開発目標（SDGs）について重要な国際的プロセスが複数あり、この機会を活用して海外の会議で調査を行った。 当初の予定では、グローバル行政法論について、その歴史的な発展過程を文献調査によって整理することまで本年度に行うこととしていた。しかし、本プロジェクトが、水という素材に着目し、理論を特定の領域の実行を説明できるか検討する事例研究としての性格を有することから、様々な文献および実行の調査に時間を取られることとなり、当初に予定した通りに理論研究に時間を割くことができなかった。来年度にも、引き続き行うべき実証研究が存在していることから、グローバル行政法論の史的分析については先行研究に譲り、水に関する国際実行の説明力の検証と、国内水法との比較によって導かれる示唆に焦点を絞り、今後の研究を進めていく。


• 「水のグローバルガバナンス」の法学的分析―水への権利と民営化の関係を中心に―

  本年度の前半は、三つの研究を行った。第一に、水への権利の詳細な解釈である。関連する決議文に加え、判例や国連文書、その他の報告書などといった資料を用いて、水への権利の内容を明らかにする作業を行った。第二に、持続可能な開発目標（SDGs）の指標に関する研究を行った。公表されている資料や会議での関係者へのインタビューを通し、指標が持つ規制的作用を明らかにし、水への権利を実現するメカニズムとして位置づけられるか検討した。この研究成果は、3度にわたって研究会やワークショップの場で報告している。第三に、水への権利を水供給に関する国内公共政策として実施する上で、国際規範を運用用語へ「翻訳」する過程を記述するために、国際的なパートナーシップの活動を参与観察した。プロジェクトベースリサーチとして、国際水協会（IWA）にて在外研究を実施し、参加の概念について調査を行った。その内容は、実践研究としての側面とアウトリーチ活動としての側面を合わせた形で、11月にブエノスアイレスで開催された国際会議のワークショップの場で報告した。 本年度の後半は、博士論文の執筆に注力し、これまでの研究成果を体系的にまとめなおした。まず、グローバル行政法の理論を発展させることで、「水のグローバルガバナンス」を行政として把握しうることを提示している。次に、水への権利をとらえなおし、グローバルな行政行為を方向付ける規範的基準として用いることが出来るとの考えから、これまで収集した資料を用いて、斬新な角度から当該権利の法的地位と内容を論じている。そして、水への権利から導かれた基準と比較する形で、投資条約仲裁や世界銀行、社会権委員会や持続可能な開発目標の監視メカニズム、パートナーシップなどの活動を、これまでの実証をまとめている。なお、博士論文の内容は、国際法研究会で報告しており、今後は出版に向けて準備を進める予定である。
